Terms of Service — dpedavis.com

These Terms of Service (the "Terms") are an agreement between you and Ryan A. Davis, operating dpedavis.com from 2100 East Panorama Drive, Unit 210, Signal Hill, CA 90755 (the "Operator," "we," or "us"). By creating an account or using dpedavis.com (the "Site"), you agree to these Terms and to the Site's Privacy Policy. If you do not agree, do not use the Site.

1. What the Site Is

The Site provides administrative tools and information for scheduling and administering pilot checkrides and flight training — including accounts, checkride applications, document uploads, and eligibility workups. The Site is a scheduling and record-keeping tool. It does not provide flight instruction through the website, and nothing on the Site replaces the regulations, FAA guidance, or the judgment of an examiner conducting a practical test.

2. Your Account

• You must provide accurate, current information when you create your account and keep it up to date.
• You are responsible for keeping your password confidential and for all activity under your account.
• You may not share your account, let another person use it, or create an account for someone else without their permission.
• Tell us promptly at pilot.ryan.davis@gmail.com if you believe your account has been accessed without authorization.

3. Applications and Information You Submit

• Information you submit — including application answers, FTN and IACRA details, and uploaded documents — must be truthful, complete, and your own (or submitted with the document owner's permission).
• You are responsible for the accuracy of everything you submit. Incorrect or incomplete information can delay or prevent a checkride, and eligibility is always determined under the applicable regulations at the time of the test.
• Uploaded documents must be legible and complete. An eligibility workup is only as reliable as the documents it is based on.

4. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose or in violation of FAA regulations
• Submit false, misleading, or altered documents or information
• Attempt to access another user's account or data
• Interfere with, disrupt, or attempt to compromise the security of the Site
• Upload malicious code or automated scraping tools
• Misrepresent your identity, certificates, or qualifications

5. Payments

Some services on the Site (such as eligibility processing) require payment. Payments are processed by Stripe under Stripe's own terms. Fees are stated at the time of purchase. Except where a service description says otherwise, fees for a service that has been performed are not refundable.

6. Intellectual Property

The Site's content, design, text, and software belong to the Operator or its licensors and are protected by law. You may use the Site only for its intended purpose. You retain ownership of the documents you upload; by uploading them, you give us permission to store, process, transmit, and review them (including through the AI-assisted review described in the Privacy Policy) as needed to provide the Site's services.

7. Eligibility Workups — Important Limits

Eligibility workups produced through the Site are an administrative review of the documents and information you provided. They are advisory only. They are not a guarantee that you meet the requirements for any certificate, rating, or practical test, they are not an FAA determination, and the examiner's determination on the day of the test controls. You remain solely responsible for meeting all regulatory requirements.

8. Disclaimer of Warranties

The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability and fitness for a particular purpose, to the maximum extent permitted by law. We do not warrant that the Site will be uninterrupted or error-free, or that any workup or schedule will be free of mistakes.

9. Limitation of Liability

To the maximum extent permitted by California law, the Operator's total liability arising out of or relating to the Site or these Terms will not exceed the total amount you paid to the Operator through the Site in the twelve months before the claim arose (or one hundred dollars if you paid nothing). In no event will the Operator be liable for indirect, incidental, special, or consequential damages, including lost profits or the cost of a rescheduled checkride.

Nothing in these Terms limits liability that cannot lawfully be limited, including liability for fraud, gross negligence, willful misconduct, or violation of law.

10. Termination

We may suspend or terminate your account at any time if you violate these Terms, submit false information, or misuse the Site. You may close your account by contacting us at pilot.ryan.davis@gmail.com. Sections of these Terms that by their nature should survive termination — including Sections 6 through 9 and Section 11 — will survive.

11. Governing Law

These Terms are governed by the laws of the State of California. Any dispute arising out of these Terms or the Site will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to jurisdiction there.

12. Changes to These Terms

We may update these Terms from time to time. When we make a material change, we will post the updated version on the Site and update the effective date above. Your continued use of the Site after a change takes effect means you accept the updated Terms.

13. Notice to California Users

Under California Civil Code § 1789.3, California users are entitled to the following notice. The Site is provided by Ryan A.
